Nell’appalto di opere pubbliche (e private), il principio secondo cui il prezzo per le opere a corpo è fisso ed invariabile (determinando in capo all’Esecutore il rischio relativo alla maggiore quantità di lavoro resasi necessaria rispetto a quella prevedibile) è applicabile unicamente laddove siano correttamente rappresentati tutti gli elementi che possono influire sulla previsione di spesa dell’Esecutore. In concreto, quest’ultimo, al momento dell’offerta, deve poter correttamente rappresentarsi tutti gli elementi che possono influire sulla sua previsione di spesa.
